Attempt is half

An attempted crime gets you half the penalty of the target crime. In other criminal law news, I can pretty well work my way through the Murder chart as worked out by my professor. However, vicarious liability in its various incarnations is still my weak spot. It's 12:30 am and in 18 hours I have to take this frigging criminal law exam.

I think I know why I enjoyed Civil Procedure so much. It's definite. There are right and wrong answers. Even at the outer reaches of personal jurisdiction, the cause of action either arises from defendant's purposeful contacts with the forum, or it does not.

Here, Prof. Crim Law has gone on and on about how there are no right answers, until at last I have concluded that her true purpose is to laugh at our answers. She claims that she doesn't understand why we want definiteness and I had to explain it's because our analysis usually leads us to conclusions in direct opposition to those of the court. Well of course, she says, as if she knew that all along. It's simply a matter of us needing to understand the issues that the court is grappling with. Personally, I think that we understand the issues that the court is grappling with just fine. So far we've seen wrong decisions and faulty decisions and other decisions that lead me to believe that the court is simply out to get the defendant. that's some criminal justice system we've got there.
